U Mostaru održano četvrto javno predstavljanje rezultata ,,Studije mapiranja institucionalnog kršenja ljudskih prava u Bosni i Hercegovini”
Dana 29. oktobra 2021. godine, u hotelu ,,Bristol” u Mostaru, održano je četvrto po redu predstavljanje rezultata ,,Studije mapiranja institucionalnog kršenja ljudskih prava u Bosni i Hercegovni”.
Predstavljanje rezultata je uvodnim izlaganjem o ciljevima projekta otvorio doc. dr Davor Vidaković, profesor Pravnog fakulteta u Lukavici. Autor Studije, prof. dr Aleksandar Ivanović, profesor Pravnog fakulteta u Lukavici, prisutnima je predstavio rezultate sprovedenog istraživanja kojim su identifikovana institucionalna kršenja ljudskih prava iz oblasti slobode mišljenja i izražavanja, slobode mirnog okupljanja i slobode kretanja; zaključke do kojih je došao u izradi Studije, kao i preporuke za unapređenje stanja na polju zaštite ova tri ljudska prava u Bosni i Hercegovini.
Prof. dr Dženeta Omerdić, profesorica Pravnog fakulteta u Tuzli, je kroz tumačenje odredaba Evropske konvencije o zaštiti ljudskih prava i osnovnih sloboda i interpretaciju pojedinih slučajeva iz prakse Evropskog suda za ljudska prava, prisutnima izložila evropske standarde o pitanju zaštite tri naprijed navedena ljudska prava.
Predstavljanju rezultata prisustvovali su predstavnici Sveučilišta u Mostaru, kao i Univerziteta ,,Džemal Bijedić” iz Mostara, predstavnici Ministarstva pravde i uprave Hercegovačko-neretvanskog kantona, predstavnici Ministarstva unutrašnjih poslova Zapadno-hercegovačkog kantona, predstavnici Kantona 10 Livno, predstavnici Hercegovačko-neretvanskog kantona, predstavnici PU Trebinje i nevladine organizacije.
Tokom diskusija koje su vođene po izlaganju panelista, predstavnici Ministarstva pravde i uprave ukazali su na problem neusklađenosti prekršajnog zakonodavstva na nivou Bosne i Hercegovine, što jednim dijelom dovodi do postojanja pravne nesigurnosti u smislu neadekvatne primjene pravnih normi materijalnog i procesnog prekršajnog zakonodavstva od strane policije i sudova.
Pored ovoga, predstavnici Ministarstva unutrašnjih poslova su istakli da je u sva tri naprijed navedena kantona pokrenuta inicijativa za izmjene i dopune zakona o slobodi mirnog okupljanja, te da su svjesni izazova u smislu adekvatnog normiranja oblasti koja se odnosi na udruživanje građana radi javnog izražavanja zajedničkog stava odnosno mišljenja.
The fourth public presentation of the results of the “Study on Mapping Institutional Violations of Human Rights in Bosnia and Herzegovina” held in Mostar
The fourth presentation of the results of the “Study on Mapping Institutional Violations of Human Rights in Bosnia and Herzegovina“, took place at the Bristol Hotel in Mostar, on October 29, 2021.
The presentation of the results was intorduced by PhD Davor Vidaković, professor at the Faculty of Law in Lukavica. Author of the Study, PhD Aleksandar Ivanović, professor at the Faculty of Law in Lukavica, presented to the audience the results of a research that identified institutional violations of human rights in the field of freedom of opinion and expression, freedom of peaceful assembly and freedom of movement; the conclusions reached in the preparation of the Study, as well as the recommendations for improving the situation in the field of protection of these three human rights in Bosnia and Herzegovina.
PhD Dženeta Omerdić, professor at the Faculty of Law in Tuzla, through the interpretation of the provisions of the European Convention for the Protection of Human Rights and Fundamental Freedoms and the interpretation of individual cases from the case law of the European Court of Human Rights, presented European standards on the protection of three human rights.
The presentation of the results was attended by representatives of the University of Mostar, as well as the University “Džemal Bijedić” from Mostar, representatives of the Ministry of Justice and Public Administration of Herzegovina-Neretva Canton, representatives of the Ministry of Interior of West Herzegovina Canton, representatives of Canton 10 in Livno, representatives of Herzegovina-Neretva Canton, representatives of Trebinje Police Department and non-governmental organizations.
During the panel discussions, representatives of the Ministry of Justice and Public Administration pointed out the problem of inconsistency of misdemeanor legislation at the level of Bosnia and Herzegovina, which in part leads to legal uncertainty in terms of inadequate application of legal norms of substantive and procedural misdemeanor legislation by the police and courts.
Furthermore, representatives of the Ministry of Interior pointed out that in all three above-mentioned cantons an initiative has been launched to amend the law on freedom of peaceful assembly and that they are aware of the challenges in terms of adequate standardization of the area related to the association of citizens for the purpose of public expression of a common opinion.
